1) Loan Terms: APR, Repayment & Fees
1.1 APR Range
The Annual Percentage Rate ("APR") is the yearly cost of borrowing expressed as a percentage and may include both interest and certain eligible fees.
APR ranges for financial products you may access through the BG Smart Loans mobile application (the "App") can be up to 35%. The APR you are offered depends on several factors, including (but not limited to):
- Your credit profile and credit history
- The amount you request
- The repayment term
- Applicable state laws and regulations
- The specific underwriting criteria of the lender making the offer
You will always be shown the final APR and key cost information for any product before you accept an offer. BG Smart Loans requires its lending partners to disclose pricing in accordance with all applicable federal and state consumer-protection laws.
1.2 Repayment Periods
Repayment terms vary by lender and product. Typical repayment periods range from approximately 3 months (about 90 days) up to 24 months (2 years).
Some offers may have shorter or longer repayment terms if allowed under applicable law. Prior to entering into any agreement, you will receive a repayment schedule that clearly states:
- The number of payments
- The amount of each payment
- The due dates for each payment
1.3 Payment Frequency & Methods
Payments are generally made in fixed, scheduled installments on predetermined dates. Depending on the lender and product, payments may be weekly, biweekly, semi-monthly, or monthly.
Repayments are typically made by electronic transfer (ACH debit) from your verified bank account, though some lenders may offer additional payment methods. You are responsible for ensuring sufficient funds are available on each due date.
1.4 Fees & Other Charges
Any potential fees associated with your offer—such as origination fees, late payment fees, returned payment or NSF charges, and expedited funding fees—will be clearly disclosed before you accept the offer. BG Smart Loans and its partners comply with all applicable federal and state rules that limit or regulate fees.
There are no hidden fees. You will always have an opportunity to review the total cost of credit before you agree to a loan or cash advance.
1.5 Early Repayment
In many cases, products available through the App allow you to pay off your balance early without a prepayment penalty. Paying off your obligation ahead of schedule may reduce the overall amount of interest you pay. Review your specific agreement to confirm how early payoff is handled.
1.6 Example Cost Disclosures
Before you finalize any loan or cash advance, you will receive a standardized cost disclosure (such as a Truth-in-Lending-style disclosure). This document will clearly outline APR, finance charges, total amount of all payments, and payment due dates.
2) Your Agreement to These Terms
These Terms of Use ("Terms") are a binding contract between you ("you," "your," or "User") and BG Smart Loans LLC ("BG Smart Loans," "we," "us," or "our"). They govern your access to and use of the BG Smart Loans mobile application, website, and related services (together, the "App").
By downloading, installing, registering for, or using the App, you confirm that:
- You are at least 18 years old (or the age of majority in your state of residence).
- You are a lawful resident of the United States.
- You are able to enter into legally binding agreements under applicable state and federal law.
By using the App, you acknowledge that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, you must stop using the App immediately.
3) Purpose of the App & Service Overview
The BG Smart Loans App is designed to provide a secure, convenient platform where users can explore, compare, and connect with potential financial offers. Through the App, you can:
- Submit a brief request that may include personal, employment, and banking details.
- Be matched with participating financial institutions and service providers that may present offers tailored to your profile.
BG Smart Loans provides the technology platform, facilitates secure data transmission, and offers customer support related to the App. BG Smart Loans does not control, manage, or guarantee the lender's approval decision, your interest rate, the repayment schedule, or the lender's customer service policies.
4) Eligibility & Your Responsibilities
To create and maintain an account on the App, you must meet all of the following requirements:
- You are at least 18 years old (or the legal age of majority in your state).
- You are a U.S. citizen or permanent resident.
- You have a valid Social Security number or other identification required by law.
- You maintain an active checking account in your name.
- You have a verifiable source of income.
- The information you provide is accurate, complete, and current.
- You agree to use the App only for lawful, personal, non-commercial purposes.

5) Electronic Communications & Your Consent
By using the App, you agree to receive electronic communications from us, including emails, text messages, in-app notifications, and electronic documents. You understand that electronic records and signatures carry the same legal effect as paper documents and handwritten signatures.
You may withdraw your consent by contacting us at support@bgsmartloans.com. However, withdrawing consent may limit your ability to use certain features.
6) Account Creation, Access & Maintenance
When registering, you agree to provide true, accurate, and verifiable information and keep it updated. You must not share login credentials, use another person's identity, or misrepresent any information.
7) Data Accuracy & Authorization
By submitting information through the App, you authorize BG Smart Loans to collect and process your information, transmit it to participating financial institutions, and use third-party tools to verify your identity, income, and bank account ownership.
You represent that all information you provide is truthful, current, and complete. Submitting false information may result in denial of your request, suspension of your account, or possible legal action.
8) Fees, Payments & Our Compensation
BG Smart Loans does not charge you a direct fee to download or use the App. However, BG Smart Loans may receive a referral fee, marketing fee, or other compensation from a lender or financial partner if you are connected with them or take out a loan through the platform.
Any compensation we receive does not change the terms of the offer you receive from the lender.
9) Permitted Use & Prohibited Activities
You agree to use the App only in ways that comply with these Terms and applicable laws. You may not:
- Use the App in any way that violates federal, state, or local law
- Attempt to gain unauthorized access to any systems, accounts, or data
- Use robots, scrapers, or automated tools to extract data
- Upload viruses, malware, or harmful code
- Reverse-engineer or attempt to discover the source code
- Copy, modify, or distribute any part of the App without permission
- Use the App to send unsolicited messages or spam
10) Service Changes & Availability
BG Smart Loans may at any time add, change, or remove features, temporarily or permanently suspend the App, or perform maintenance. We are not responsible for any loss or inconvenience due to service interruptions.
11) Intellectual Property
All content and technology associated with the App—including text, logos, graphics, software, and design—are owned by BG Smart Loans LLC or its licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, lawful use. Any unauthorized use is strictly prohibited.
12) Disclaimers
The App and all related information, tools, and services are provided on an "as is" and "as available" basis. To the fullest extent allowed by law, BG Smart Loans makes no warranties or representations about the accuracy, reliability, or completeness of the App's content or features, and does not guarantee uninterrupted, error-free, or secure access.
We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. You use the App at your own risk.
13) Limitation of Liability
To the maximum extent permitted by law, BG Smart Loans LLC, along with its affiliates, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill arising out of or related to your use of the App.
Our total cumulative liability to you for any and all claims will not exceed one hundred U.S. dollars (USD $100).
14) Indemnification
You agree to defend, indemnify, and hold harmless BG Smart Loans LLC and its officers, employees, affiliates, partners, and agents from any claims, demands, damages, losses, costs, and expenses (including reasonable attorneys' fees) that arise out of your use or misuse of the App, your violation of these Terms, any applicable law, or any rights of another person or entity.
15) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.
Any dispute arising out of these Terms or your use of the App will be resolved through individual binding arbitration under the Federal Arbitration Act. Class actions and representative proceedings are not permitted. You may bring claims only in your individual capacity.
If arbitration is not available, disputes shall be brought exclusively in the state or federal courts located in Delaware.
16) Termination
We may suspend or terminate your access to the App if we believe you have violated these Terms or applicable law, or if your use is harmful to us, our partners, or other users.
You may stop using the App at any time by deleting it from your device and closing your account. Sections of these Terms that should survive termination will continue to apply.
17) Changes to These Terms
BG Smart Loans may update these Terms from time to time. When we do, we will update the "Effective Date" at the top. Your continued use of the App after changes become effective means you accept the updated Terms.
